体育赛事节目的市场价值巨大，但其著作权保护的实际效果却不容乐观，根本原因在于目前 的制度供给未能充分适配数字时代传播手段的革新，不符合体育赛事节目的特性。数字时代的技术革 新对体育赛事节目的传播而言是双刃剑，数字技术助长了著作权侵权行为的扩大化，但也是解决体育赛 事节目著作权保护问题必须依赖的重要手段。现行法框架下的诉前行为保全、避风港规则、损害赔偿和 惩罚性赔偿，在侵权治理实效上均有明显不足。版权内容过滤义务的引入，可以在司法程序启动之前， 将禁止范围扩展至即将发生的侵权行为，第一时间实现救济。尽管版权内容过滤义务的引入还存在一 些争议，但通过精细化改造可以实现大规模侵权行为的高效治理。“差序格局”版权内容过滤义务的引 入，有利于实现司法救济的及时性、有效性和妥当性，是今后通过制度完善以回应数字时代变革的努力 方向。

Sports event programs possess substantial market value， however， the practical efficacy of their copyrightprotection remains unsatisfactory. The fundamental reason lies in the current institutional framework failing to adequatelyadapt to the innovations in digital-era dissemination methods and does not align with the unique characteristics of sportsevent programming. In the digital age， technological innovation is a double-edged sword for the dissemination of sportsevent programmes： while it facilitates the proliferation of copyright infringement， it also constitutes an indispensablemeans upon which the protection of copyright in sports event programmes must rely. Under the current legal framework，pre-litigation preservation measures， safe harbor rules， compensation for damages， and punitive damages all have obviousshortcomings in the effectiveness of tort governance. The introduction of copyright content filtering obligations enables theextension of prohibitory scope to encompass imminent infringing acts prior to the initiation of judicial proceedings，therebyfacilitating immediate remedial action. Although the introduction of copyright content filtering obligations remains somewhatcontroversial， targeted refinements can enable the effective management of large-scale infringement. By introducing suchobligations through a“differential mode of association，” we can ensure the timeliness， effectiveness， and appropriateness ofjudicial remedies. This approach represents the direction for future efforts to respond to the transformations of the digital agethrough institutional improvements.
