体育赛事活动视听作品是一类独立的视听作品，对塑造和传播社会主导价值观具有不可替代 的作用。目前，体育赛事活动视听作品的法律纠纷日益增多，已经影响了正常的体育赛事秩序，急需开 展深入研究，并提出应对之策。就法理而言，体育赛事活动视听作品是指体育赛事活动及其相关领域内 生成的具有独创性的连续画面，并以一定形式表现的智力成果，主要包括直播类、独立创作类、衍生类3 种类型。在法治实践中，不同类型体育赛事活动视听作品的生成场景存在显著差异，需要分别予以明确。 综合案例分析和学理探究，体育赛事活动视听作品的核心认定标准如下：一是有助于弘扬中华体育精 神，培育中华体育文化；二是最低限度的独创性“连续画面”；三是具象化的载体形式表现。三者内在统 一、不可分割，共同引导相关权益保护举措的完善，推动赛事活动有序融合发展。

As a distinct category of audiovisual works， sports events audiovisual works play an irreplaceable and significant role in shaping and disseminating dominant social values. Currently， legal disputes involving such works are increasing， severely disrupting the normal order of sports events and urgently requires in-depth research to propose countermeasures. From a legal perspective， audiovisual works of sports events refer to intellectual creations generated within sports events and their related fields， characterized by original continuous frames expressed in a tangible form. They primarily include three types： live broadcast works， independently created works， and derivative works. In legal practice， the generative contexts vary significantly among these types， demanding separate clarification. Through comprehensive case analysis and theoretical exploration， three identification criteria for audiovisual works of sports events are proposed： first， it helps to promote the Chinese sports spirit and cultivate Chinese sports culture； second， it requires a minimum level of originality of“continuous frames”； third， it requires concrete carrier form expression. These criteria are inherently unified and indivisible， collectively guiding the improvement of relevant rights protection and advancing the orderly and integrated development of sports events.
