科学、合理、有效的数据产权制度是充分发挥体育赛事数据经济和社会价值的关键举措。在 结合既有理论成果的前提下，研究尝试通过法经济学范式创新论证体育赛事数据产权制度构建的法理 基础。基于法经济学成本收益视角，推动体育赛事数据产权法定化对包括运动员、体育赛事组织者、体 育赛事数据处理者等多元数据主体均具有显著的正向效率。结合法经济学的相关理论分析，研究认为： 以更好实现体育赛事数据产权制度安排效率最大化为基本原则，我国应当遵循“场景化+动态化”的复 合型思路，分类、有序、审慎地推动构建以“独创性+实质投入”为标准的体育赛事数据产权制度。

A scientific， reasonable and effective data property right system is a key initiative to fully utilize the economic and social value of sports event data. On the premise of combining the existing theoretical research， this study tries to demonstrate the legal basis for the construction of the sports event data property right system through the innovation of the law and economics paradigm. From a cost-benefit standpoint in law and economics， the legalization of property rights for sports event data yields significant positive efficiency outcomes for various stakeholders， including athletes， sports event organizers and event data processors. Drawing on the theoretical analysis of legal economics， the study concludes that， based on the basic principle of maximizing the efficiency of the institutional arrangement of sports event data property rights，China should follow the composite idea of“scenario + dynamization”，and promote the construction of a sports event data property rights system in a classified，orderly and prudent manner，using“originality+substantial investment” as key criteria.
